ChatGPT (OpenAI).On the free tier, conversations are used to train OpenAI's models by default. You can opt out, but the default position is that your data is in the training pool. On the Business, Enterprise, and API tiers, data is contractually excluded from model training by default. The API also offers zero data retention options, meaning your data is processed and discarded, with nothing stored on OpenAI's servers beyond the immediate request. For any business handling customer data, the API or Business tier is the minimum appropriate choice. The free tier should not be used for client or customer information.
Microsoft Copilot. Within the Microsoft 365 ecosystem, Copilot processes data within your existing Microsoft tenancy. Microsoft has committed to data residency and in-country processing for EU and UK customers, and the data is covered by your existing Microsoft data processing agreement. For businesses already using Microsoft 365, Copilot is one of the lower-risk AI tools from a data protection perspective because the data stays within a system you already trust.
Google Gemini.Google's AI services offer data residency options and are covered by Google Cloud's data processing terms. For businesses using Google Workspace, the integration follows the same data protection framework as the rest of the Google suite.
Anthropic (Claude).Claude's API does not use customer data for model training. Conversations via the API are not stored beyond the immediate processing unless the customer opts in to feedback features. The business terms are clear on this point.
The pattern is consistent: consumer/free tiers offer weaker data protections, while business and API tiers provide contractual guarantees that your data is not used for training and can be retained for zero or minimal periods.
When You Need a DPIA
A Data Protection Impact Assessment is a formal assessment of the risks that a data processing activity poses to individuals. Under UK GDPR, you must carry out a DPIA when processing is "likely to result in high risk" to individuals.
For most Essex SMEs deploying a chatbot, voice AI, or workflow automation tool, a DPIA is not required. The UK-US Data Bridge, effective from October 2025, provides this mechanism for US companies that have self-certified under the UK Extension to the EU-US Data Privacy Framework. All the major AI providers have opted into this framework. In practical terms, this means that transfers of personal data to these providers are lawful under UK GDPR without you needing to put additional contractual safeguards in place, as long as the provider is on the certified list.

You do not need to negotiate Standard Contractual Clauses or carry out Transfer Impact Assessments for the major AI platforms. Check that your provider is on the certified list (the ICO maintains a link to the US Department of Commerce register), and document that you checked.

The Data Use and Access Act, which came into force in February 2026, makes several changes relevant to SMEs using AI.
The rules around automated decision-making have been simplified. Minor decisions can be fully automated without additional safeguards. Decisions with significant effects on individuals still require human involvement and the right for the individual to challenge the decision. For a chatbot that qualifies a sales lead, this is a minor decision. For an AI system that decides whether to approve a loan application or shortlist a job candidate, human oversight is required.
The Act also introduces a clearer legal framework for using data to train, test, and deploy AI systems, and expands the purposes that are considered "automatically compatible" with the original collection purpose. One practical change: businesses must now acknowledge and resolve internal data protection complaints within 30 days. If a customer complains about how their data was used by your AI system, you have a month to respond with a resolution.
ICO Enforcement: What Is Actually Happening
The ICO has been active on AI enforcement, though most actions have targeted large organisations rather than SMEs. In 2025, the ICO issued fines of £3.07 million and £2.31 million to companies in the Capita group for data breaches. The Clearview AI case established that the ICO can enforce against non-UK AI providers that process UK residents' data.

Third, add a clear disclosure wherever a customer interacts with AI: a chatbot greeting, a call opening, or an email footer. Fourth, check that the AI provider is on the UK-US Data Bridge certified list (if US-based) or has a UK data processing agreement. Fifth, run through the ICO's DPIA screening checklist. If none of the triggers apply, note that you checked and file it. Sixth, brief your team on the tool, what data it handles, and what not to put into it (sensitive personal data, passwords, information beyond what the tool needs).
